A land worth crores grabbed with fake 7/12 extract

Virat Constrictions began constructing a building in Atali-Vadavali village (Kalyan Dombivali Municipal Corporation) (KDMC) in Thane district of Maharashtra in the year 2012.

The developer began construction work on 56 gunthas. Of these 25 guntha land belonged to a local resident Ashok Kathod Bhagat. The developer Paresh Ishwarlal Parikh prepared a bogus 7/12 land extract and annexed it with his own land and went ahead with construction of the building, Bhagat alleged.

Bhagat filed a complaint against the developer Parikh with Thane Collector. In response to the complaint, the collector’s office admitted that the 7/12 land extract submitted by Parikh was bogus. The collector also ordered inquiry against the concerned tehsildar who has authorized the transfer of land fraudulently. The collector also ordered cancellation of the Occupation Certificate granted to the developer.

However the then Assistant Town Planner of KDMC M. D. Rathod, told Bhagat that since the developer has moved the Bombay High Court, no action can be taken in the matter till such time the issue is resolved.

On February 13, 2019, the Bombay High Court ruled that the developer Parikh and his firm had tampered with 7/12 land extracts and such action be taken against him within 4 weeks. Although over two years have passed by, no action has been taken against the developer by the KDMC as yet.

The action against the developer has not been taken due to the money deals between Parikh and former Assistant Town Planner M. D. Rathod and existing Assistant Town Planner D. P. Sawant, senior social worker and advocate Dilip Inkar said.

Parikh family, an expert in land-grab
The entire Parikh family is associated with the Constructions. Paresh Ishwarlal Parikh, Akash Paresh Parikh and Shilpa Paresh Parikh are on the Board of Directors. Besides, Pritesh Mahesh Patel, Sneha Pritesh Patel and Piyush Mahesh Patel are involved in the land-grab, along with these directors. The Virat Constructions has grabbed several pieces of land with fake and forged documents in KDMC, Dilip Inkar added.
